If one parent dies while both parents have parental authority, the surviving parent normally continues with sole parental authority automatically, so the appointed guardian does not replace that parent. If no parent with authority remains and there is no effective guardian appointment, the designated guardian refuses, or another legal issue arises, the court may need to determine who will exercise Dutch law allows a parent to designate one person or two people who should exercise guardianship over a minor child after the parent&#8217;s death, provided the appointment is legally effective at that time. The Dutch government identifies both the Parental Authority Register and a will as valid ways to make that choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important Dutch terminology is <strong>gezag<\/strong> and <strong>voogdij<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Gezag<\/em> means legal authority over a minor. When it is exercised by a parent, it is normally described as parental authority. When the authority is exercised by someone other than a parent, it is called <em>voogdij<\/em>, or guardianship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters because appointing a guardian does not normally allow that person to take over while a parent with parental authority remains entitled to exercise it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_Can_Be_Appointed_as_a_Guardian\"><\/span>Who Can Be Appointed as a Guardian?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A guardian must be legally capable of exercising authority over a minor, and parents should also consider whether the person is realistically able to take responsibility for the child. Official Dutch guidance lists requirements including adulthood and legal capacity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal minimum should not be the only consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents should discuss practical questions such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the guardian&#8217;s relationship with the child;<\/li>\n\n\n\n<li>parenting values;<\/li>\n\n\n\n<li>housing and family circumstances;<\/li>\n\n\n\n<li>health;<\/li>\n\n\n\n<li>willingness to care for siblings;<\/li>\n\n\n\n<li>financial circumstances;<\/li>\n\n\n\n<li>where the guardian lives; and<\/li>\n\n\n\n<li>whether the arrangement would require the child to move abroad.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is advisable to discuss the appointment with the proposed guardian even though formal advance acceptance is not required.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_You_Appoint_Two_Guardians\"><\/span>Can You Appoint Two Guardians?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. Parents may appoint two people to exercise guardianship jointly, although joint guardianship carries additional responsibilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This should therefore be a deliberate decision rather than simply naming a married couple because they live together.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dutch government guidance distinguishes between sole and joint guardianship. A sole guardian is responsible for the child&#8217;s care and legal representation but is not automatically personally required to pay the child&#8217;s maintenance costs. Where two people exercise joint guardianship, they are expected to care for and raise the child together and are jointly responsible for maintenance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_Do_You_Appoint_a_Guardian_in_the_Netherlands\"><\/span>How Do You Appoint a Guardian in the Netherlands?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are two principal methods: register the guardian in the <strong>Parental Authority Register (gezagsregister)<\/strong> or include the appointment in a <strong>will through a civil-law notary<\/strong>.
